The Employer Information Report EEO-1 (EEO-1 Report) is required to be filed with the Equal Employment Opportunity Commission’s (EEOC) EEO-1 Joint Reporting Committee on September 30, 2013. Generally, all private employers with 100 or more employees that are subject to Title VII must file this report, although there are a few exceptions. Federal contractors and first-tier federal subcontractors are also obligated to meet this requirement. The EEO-1 Report requires the disclosure of company data, including federal contractor status, and employment data by job categorized by job category, race/ethnicity, and gender. The preferred method for filing the report is the web-based filing system, which requires employers to log into an EEOC database with a login ID and password. 

In anticipation of the 2013 filing deadline, the EEOC recently announced that all passwords for the 2013 EEO-1 Survey have been reset for security and confidentiality purposes. Employers should expect to shortly receive new passwords from the EEOC through notification letters.

Because the Office of Federal Contract Compliance Programs (OFCCP) has increased its scrutiny of EEO-1 Reports while establishing jurisdiction and conducting compliance evaluations, federal contractors and private employers alike should pay special attention when filing EEO-1 Reports.
